CANNYQUIZ TERMS AND CONDITIONS
Version 4.0 — Effective Date: 19 July 2026
1. INTRODUCTION
1.1 These Terms and Conditions ("Terms") govern your use of the CannyQuiz skill-based prize competition platform ("Platform"), operated by CannyQuiz Ltd, a company registered in England and Wales (17242385), with its registered office at Gateway Business Centre, Barncoose, Redruth, Cornwall TR15 3RQ ("we", "us", "our", "the Operator").
1.2 By creating an account, entering a competition, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
1.3 The Platform operates skill-based prize competitions under section 14(5) of the Gambling Act 2005. These are not lotteries or gambling products. Entry requires the demonstration of skill (answering quiz questions correctly within a time limit), and the skill element is designed to prevent a significant proportion of participants from qualifying for the prize draw.
1.4 Key definitions used in these Terms: - "Competition" means an individual skill-based prize competition run on the Platform. - "Competition Rules" means the specific rules, parameters, and revenue allocation for each Competition period, as published on the Platform. - "Entry" means a single attempt to answer the quiz questions in a Competition. - "Entry Fee" means the fee payable to submit an Entry, as displayed on the entry page. - "Bundle" means a discounted package of multiple Entries purchased in a single transaction. - "Draw" means the random selection of a winner from all qualifying Entries. - "Qualifying Entry" means an Entry where all quiz questions have been answered correctly within the time limit. - "Station Partner" means a radio station or media partner through which the Platform is white-labelled. - "Prize Fund" means the portion of Entry Fee revenue allocated to prizes, as set out in the Competition Rules.
2. ELIGIBILITY
2.1 To use the Platform and enter Competitions, you must: (a) be aged 18 or over; (b) be a resident of the United Kingdom; (c) not be an employee, officer, or director of the Operator, any Station Partner, or their immediate family members; (d) not be involved in the administration, development, or operation of the Platform or any Competition.
2.2 We reserve the right to request proof of age and residency at any time. Failure to provide satisfactory evidence may result in account suspension and forfeiture of any unclaimed prizes.
2.3 You may only hold one account on the Platform. Creating multiple accounts is prohibited and may result in the closure of all your accounts and forfeiture of any entries or prizes.
3. ACCOUNT REGISTRATION
3.1 To enter Competitions, you must create an account by providing a valid phone number or email address and confirming you meet the eligibility requirements.
3.2 If you register with a phone number, you may optionally provide an email address for prize notifications and communications. If you register with an email address, you may optionally add a phone number for prize call purposes.
3.3 You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
3.4 You must provide accurate and complete information during registration and keep your details up to date.
3.5 We may suspend or terminate your account at our discretion if we reasonably believe you have breached these Terms, provided false information, or engaged in fraudulent activity.
4. ENTRY FEE AND PAYMENT
4.1 Entries may be purchased individually or in discounted Bundles. The available options and prices are displayed on the entry page before purchase. Each Entry in a Bundle counts as a separate Entry towards the maximum entry limit.
4.2 Payments are processed securely via Paytriot, our third-party payment processor. You will be redirected to the Paytriot hosted payment page to complete your payment. We do not store, process, or have access to your full card details at any time.
4.3 Payment must be completed before you can attempt the quiz questions. Your Entry is only submitted once you have completed the quiz.
4.4 All payments are in pounds sterling (GBP).
4.5 Each Competition may have a maximum number of entries per person. The current limit is displayed on the Competition page and in the Competition Rules. Bundle purchases that would exceed the entry limit are not permitted.
5. HOW THE COMPETITION WORKS
5.1 Each Competition consists of a series of quiz questions. The number of questions and time limit per question are specified in the Competition Rules for each Competition period.
5.2 After paying the Entry Fee, you will be presented with the quiz questions one at a time. Each question must be answered within the time limit specified in the Competition Rules.
5.3 To qualify for the prize draw, you must answer ALL questions correctly within the time limits. This is the skill element of the Competition, which is designed to prevent a significant proportion of entrants from qualifying.
5.4 If you fail to answer all questions correctly, or if the time limit expires on any question, your Entry does not qualify for the Draw. The Entry Fee is not refundable in this case (subject to your cancellation rights set out in section 8).
5.5 Questions are designed to test genuine knowledge and skill. The difficulty level is calibrated to ensure that only a minority of entrants will answer all questions correctly, satisfying the legal requirement under the Gambling Act 2005 that the competition prevents a significant proportion of people who wish to participate from doing so, or from winning a prize, by reason of the skill element.
5.6 Once you begin answering questions, you cannot pause, restart, or revisit previous questions.
5.7 If you purchase a Bundle, each Entry is a separate quiz attempt with its own set of questions. You may play your Entries at any time before the Draw.
6. THE DRAW
6.1 At the scheduled draw time, a winner is selected at random from all Qualifying Entries for that Competition.
6.2 The Draw uses a cryptographically secure pseudo-random number generator (CSPRNG) to ensure fairness and unpredictability.
6.3 The Draw process is logged and auditable. Draw records, including the random seed, the list of qualifying entries, and the selected winner, are retained for verification purposes.
6.4 The draw schedule for each Competition is specified in the Competition Rules and displayed on the Competition page.
6.5 If no entries qualify for the Draw (i.e., no one answers all questions correctly), the prize rolls over to the next Competition or is handled as specified in the Competition Rules. 6.6 If only one entry qualifies, that entrant wins the prize automatically.
7. PRIZES AND PRIZE CALL
7.1 The prize amount for each Competition is calculated as set out in the Competition Rules. The prize may be a fixed amount or a percentage of total entry fee revenue, with a guaranteed minimum as specified in the Competition Rules.
7.2 If the calculated Prize Fund is less than the guaranteed minimum, the Operator will fund the difference.
7.3 Winners will be called live on air by the Station Partner during the prize call window specified on the entry page and in the Competition Rules. You must be available to answer a phone call during this window.
7.4 If the winner does not answer the call during the prize call window, the prize may be forfeited and a new winner selected from the remaining Qualifying Entries.
7.5 Winners must provide valid photo ID to verify their age (18+) before prize payment is processed.
7.6 Prizes will be paid electronically (e.g., bank transfer) within 28 days of successful verification.
7.7 Prizes are not transferable and cannot be exchanged for alternative prizes unless agreed by the Operator.
7.8 The Operator may publicly announce the winner's first name and county of residence unless the winner has opted out of winner publication consent in their account settings.
7.9 By entering a Competition, you confirm that you will be available during the prize call window displayed on the entry page for the relevant Competition. This is a significant condition of entry.
8. CANCELLATION AND REFUND RIGHTS
8.1 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day cancellation period for distance contracts.
8.2 However, by entering a Competition and beginning to answer quiz questions, you are accessing digital content. By proceeding to take the quiz, you expressly consent to the digital content being provided before the end of the 14-day cancellation period and acknowledge that you will lose your right to cancel.
8.3 If you have paid an Entry Fee but have NOT yet started the quiz, you may request a cancellation and full refund by contacting us at hello@cannyquiz.co.uk within 14 days of payment. Refunds will be processed within 14 days of receiving your cancellation request.
8.4 For Bundle purchases, a refund request prior to starting any quiz will result in a full refund of the Bundle price and cancellation of all Entries in the Bundle.
8.5 Once you have started answering quiz questions, no refund is available for that Entry regardless of the outcome, as the digital content has been consumed. For Bundles where some Entries have been played and others have not, only unplayed Entries may be eligible for a partial refund at the Operator's discretion.
8.6 Nothing in this section affects your statutory rights in respect of faulty digital content or services not provided as described.
9. CHARITABLE CONTRIBUTION
9.1 In accordance with section 162 of the Charities Act 2011, we make the following statement: a portion of each Entry Fee may be donated to a charitable cause. The charity and donation percentage (if any) for each Competition are specified in the Competition Rules.
9.2 The Operator selects the recipient charities at its discretion and may rotate recipients periodically. The selected charity for each Competition period is identified in the Competition Rules.
9.3 Details of charitable donations made, including the recipient charities and amounts, will be published on the Platform on a quarterly basis.
9.4 The charitable contribution is made by the Operator from its revenue. Your Entry Fee payment is made to the Operator, not directly to any charity. Entering a Competition does not constitute a charitable donation by you for tax purposes.
0. REVENUE ALLOCATION TRANSPARENCY
10.1 Revenue from Entry Fees is allocated between the Prize Fund, charitable donations (if applicable), Station Partner fees, payment processing costs, and operational costs. The exact allocation for each Competition period is set out in the Competition Rules.
10.2 These allocations may be varied from Competition to Competition. The applicable allocation is always displayed in the Competition Rules before you enter.
11. RESPONSIBLE PLAY
11.1 Although CannyQuiz competitions are skill-based and not classified as gambling, we are committed to responsible play principles.
11.2 You should only enter competitions with money you can afford to spend. Entry Fees are non-refundable once the quiz has been started.
11.3 Each Competition has a maximum entry limit per person to help prevent excessive spending.
11.4 If you are concerned about your spending, you may contact us to request a voluntary spending limit or temporary account suspension.

12. DATA PROTECTION AND PRIVACY
12.1 We collect and process your personal data (including phone number, email address, and entry history) in accordance with our Privacy Policy, available on the Platform.
12.2 You may download a copy of your personal data, update your marketing preferences, or request account deletion from your account settings page.
12.3 Your phone number is collected for the purpose of account authentication and prize notification (including the live on-air prize call). It may be shared with the relevant Station Partner solely for the purpose of contacting you during the prize call window if you are selected as a winner.
13. INTELLECTUAL PROPERTY
13.1 All content on the Platform, including but not limited to text, graphics, logos, images, quiz questions, software, and design, is the property of the Operator or its licensors and is protected by copyright, trademark, and other intellectual property laws.
13.2 You may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent.
13.3 The CannyQuiz name, logo, and brand elements are trademarks of the Operator.
14. LIMITATION OF LIABILITY
14.1 To the fullest extent permitted by law, the Operator's total liability to you for any claim arising from or related to the Platform or any Competition shall not exceed the total Entry Fees paid by you in the 12 months preceding the claim.
14.2 The Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
14.3 The Operator is not liable for any failure or delay in performing obligations due to circumstances beyond its reasonable control, including but not limited to technical failures, internet outages, acts of God, or actions of third-party service providers.
14.4 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
14.5 The Platform is provided "as is" and "as available". While we strive for continuous availability, we do not guarantee uninterrupted access and may need to suspend the Platform for maintenance or updates.
15. DISPUTE RESOLUTION
15.1 If you have a complaint or dispute, please contact us first at hello@cannyquiz.co.uk or via your account settings. We will endeavour to resolve your complaint within 14 days.
15.2 If we cannot resolve your complaint to your satisfaction, you may refer the matter to an alternative dispute resolution provider. Details of the applicable ADR provider will be provided upon request.
15.3 Nothing in this section prevents you from bringing a claim in the courts of England and Wales.
16. CHANGES TO TERMS
16.1 We may update these Terms from time to time. The current version number and effective date are shown at the top of this document.
16.2 Material changes will be notified to you by email or SMS at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
16.3 Previous versions of these Terms are retained and available on request.
17. GOVERNING LAW
17.1 These Terms are governed by and construed in accordance with the laws of England and Wales.
17.2 The courts of England and Wales shall have exclusive jurisdiction over any disputes arising from or in connection with these Terms or the Platform.
